Client Terms & Conditions
Confirmation of Booking
Provisional bookings will be cancelled if they are not confirmed within 48 hours of the proposed date of the booking. Confirmation is required in writing indicating agreement to the details of the booking and acceptance of these terms and conditions.
Payment
Payment is required within 30 days of the invoice date. After this time invoices will be handled by our debt collection agency which will immediately incur additional charges for the client. At the discretion of Y2K Promotions, a deposit may be requested to secure the booking for new clients. All invoices are payable in Pounds Sterling.
Cancellation
Bookings cancelled within 24 hours of the start of the booking itself will be charged at the full fee. Bookings cancelled within 72 hours of the start of the booking will be charged at 50% of the agreed fee. If the same model is able to be re-booked for the same assignment then a discount will be given.
The Working Day
For modelling, a standard working day is 8 hours including a 1 hour break, which the model will take to suit the day’s schedule. For promotional work, the minimum booking is for 4 hours, but 2 hours for modelling. When booking, the client must ensure that they allow enough time to complete the assignment. Y2K Promotions prefer to operate against an agreed fixed price booking rather than resort to overtime payments.
Overtime
Overtime is not compulsory when requested at the assignment and requires the consent of both the model and Y2K Promotions. Overtime rates (either 1½ times or 2 times the hourly rate) are applicable when the duration of the assignment exceeds that agreed in the booking and are calculated on a case by case basis.
Breaks & Meals
Only reasonable breaks are expected which amount to 1 hour in an 8 hour day. With a full day booking it would be expected that food and refreshment is provided during a modelling assignment.
Travel & Subsistence Costs
The booking fee will itemise travel costs. Within the UK this will generally consist of a fuel allowance, and to minimise this, girls will travel together whenever possible. Flights, hotels and subsistence can be covered directly by the client or arranged by Y2K Promotions at cost.
Weather Permitting Bookings
If an assignment is "weather permitting" then this must be made clear at the time the booking is made. Should the assignment be cancelled due to weather conditions, the client will be charged 50% of the agreed booking fee. In the event of a second cancellation, the client will be charged the full fee. Should the model arrive as agreed due to the client failing to cancel in sufficient time, the agreed booking fee will be charged in full.
Permitted Usage
The permitted use for photographs is editorial, press advertising, brochure, direct mail and experimental. The booking fee allows the right to use the image for one year from the date of the booking in the UK only. Separate fees must be negotiated for foreign use. A separate fee must be negotiated for the right to use images for any other purpose than that stated above. No images can be used until the fee has been paid in full.
Exclusion Fees
Unless an exclusivity fee has been negotiated as part of the booking, a model is entitled to advertise a competitor’s product. It is the client’s responsibility to check whether conflicting work has been done.
Tests & Experimental Photography
Photographers are not entitled to use test and experimental photographs for commercial purposes unless specific written arrangements have been made in advance with Y2K Promotions.
Insurance
It is the client’s responsibility to provide adequate insurance for the model at the assignment as if they were an employee of the client. It is also the client’s responsibility to undertake a risk assessment of the assignment location, equipment and work conditions and discuss any risk to the model’s health and safety with Y2K Promotions at the time of the booking The client is obliged to ensure all people engaged on the assignment and associated travelling are properly insured and qualified. Ultimately, the client is responsible for the model’s health and safety.
Privacy
Personal details of anyone represented by Y2K Promotions or associated person must not be passed on to any third party. Clients are not entitled to use any personal information supplied unless for the hire, or consideration of hire, of the model.
Direct Engagement
The client must not attempt to offer employment direct to the model without booking through Y2K Promotions. In the unlikely event that Y2K Promotions agrees to this, a fee will be sought from the client.
Limit of Liability
Y2K Promotions will make every conceivable effort to ensure client satisfaction. However, Y2K Promotions do not accept liability in respect for any loss, delay, expense or damage arising directly or indirectly through any cause or act as a result of negligence, dishonesty, misconduct or late arrival of any of the models.
Complaints
If the client is not satisfied with the model booked for the assignment, then Y2K Promotions office must be notified immediately and certainly within three hours of the start of the booking. If the client does not make this notification then they will deemed to have accepted the model. Retrospective complaints cannot be accepted.
General
Y2K Promotions reserve the right to negotiate within these terms and conditions. These terms and conditions are without prejudice to any claim against the client.
Commencement of a booking for anyone we represent through Y2K promotions by a client is deemed as acceptance of these terms and conditions
